Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Benton Technology ("we," "us," or "our") governing your use of the TrackMyRun mobile application and associated dashboards, websites, and APIs (collectively, the "Service"). By creating an account or using the Service you accept these Terms.

1. The Service

TrackMyRun records GPS, heart rate, pace, and split data from your Apple Watch during a run and streams those metrics to a permanent, private dashboard URL you can share. Optionally, the Service can send a single SMS message to up to two contacts you have designated when each run begins. Details of the SMS feature are described on our SMS Notifications page and incorporated into these Terms by reference.

2. Eligibility

You must be at least 13 years old to use the Service, and old enough in your jurisdiction to enter into a contract. If you are under the age of majority where you live, a parent or legal guardian must agree to these Terms on your behalf.

3. Accounts

You must register with a valid email address you control.
You are responsible for maintaining the confidentiality of your password and the device storing your authentication tokens.
You are responsible for all activity that occurs under your account.
Notify us promptly at [email protected] if you suspect unauthorized access.

4. Subscriptions and billing

Broadcasting runs requires an active subscription to TrackMyRun. Subscriptions are sold and billed through your Apple ID via Apple's App Store and StoreKit. Pricing, renewal terms, and refund eligibility are governed by Apple's standard terms.

Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
You can manage or cancel your subscription in Settings → [your name] → Subscriptions on iPhone.
Refunds are processed by Apple at reportaproblem.apple.com.
We may, at our sole discretion, grant promotional or service-credit days separate from your Apple subscription.

5. SMS Notifications — your responsibilities

Consent is on you. You may only add a phone number as a notification contact if you have the recipient's prior permission to send them automated text messages from TrackMyRun. By adding a contact you represent and warrant that you have obtained that permission.

You will not add a phone number you are not authorized to add.
You will remove a contact promptly if they ask you to stop sending them messages, or if they reply STOP.
You will not use the Service to send messages that are unlawful, harassing, deceptive, or otherwise inappropriate.
Standard message and data rates from the recipient's mobile carrier may apply.

We reserve the right to suspend or terminate accounts that violate these requirements, and to permanently block phone numbers we reasonably believe have been added without consent.

6. Acceptable use

You agree not to:

Reverse-engineer, decompile, or attempt to extract source code from the Service, except where permitted by applicable law;
Use the Service to violate any law or to infringe anyone's intellectual-property, privacy, or other rights;
Probe, scan, or attempt to circumvent the Service's authentication, rate-limit, or security mechanisms;
Submit false subscription receipts or attempt to bypass the subscription gate;
Send spam, marketing, or unsolicited messages through the SMS feature;
Resell or sublicense the Service.

7. Dashboard sharing

Your dashboard URL contains a private viewing token. Anyone with the link can view your live run. You are responsible for who you share it with. If you wish to revoke access for everyone who currently has the link, regenerate the link inside the iPhone app.

8. Apple HealthKit

TrackMyRun integrates with Apple HealthKit to read run data from Apple Watch. We use HealthKit data solely to power the Service. We do not transmit HealthKit data to advertising networks, data brokers, or any third party for marketing purposes, and we do not use HealthKit data for any purpose other than providing the Service. You can revoke HealthKit permissions at any time from the iOS Settings app.

9. Disclaimers

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. GPS measurements, heart rate readings, pace calculations, distance estimates, and SMS delivery are inherently subject to inaccuracy, delay, and outage.

TrackMyRun is not a safety, medical, or emergency service. Do not rely on the Service to summon help, to monitor a medical condition, or as a substitute for proper safety precautions while running. Always carry a means of contacting emergency services if you may need them.

10. Limitation of liability

To the maximum extent permitted by law, in no event will Benton Technology, its owners, employees, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our aggregate liability to you for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.

11. Indemnification

You will indemnify and hold harmless Benton Technology and its service providers from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your misuse of the Service, your violation of any law, or your violation of any third party's rights — including any claim brought by an SMS recipient based on your having added them as a notification contact.

12. Termination

You may stop using the Service and delete your account at any time from the iPhone app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination — including Sections 9, 10, 11, and 14 — will survive.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the iPhone app or by email. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the United States and the State in which Benton Technology is principally located, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in that State, and you and we consent to the personal jurisdiction of those courts.
